You definitely should try at least Catalyst 3.7 from ATI - should not have problems after that - cause your situation looks like driver texture management problem ( also it can be caused by videocard overclocking ). Catalyst 3.8 have some weird bugs preventing some of the recent released games to run correctly, but MA looks OK ( for 9500 and 9800, don't have opportunity to test for 8500le ). I didn't tried 3.9 at the moment, but will check it soon.
Though if you want problems - you should continue to use unofficial Omega drivers - we will not test MA with this.

well i figured out how to fix it. Omega drivers do tend to eek out a few more fps with someone with my graphics card although 3.8 and 3.9 releases offer my card no benifits (after some thruough testing) so i have rolled back. The video card is not overclocked.

So I didn't get it clearly - what driver version are you using currently? is it from ATI?
You wrote that you have tested MA with 3.8 & 3.9 ATI drivers - was it working correctly?

it worked with the omegas untill i turned all the console options to very high but put teh preformance at highly optimized instead d high quality.

I doubt most users would do this. I havn't had time to set it with the regular catalysts.
